Terms of Service

These Terms of Service (“Terms”) govern your use of the VERDANT | Plant, Garden mobile application (“VERDANT”, “App”), operated by Gesla LLC (“we”, “our”, or “us”).

By accessing or using VERDANT, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

VERDANT provides plant care tools, including:

• Plant identification and AI-based care guidance
• Plant tracking and reminders
• Community help features
• Expert and AI support chat

You agree to use the App only for lawful and personal purposes.

2. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Plant Care Information Disclaimer

VERDANT provides plant care suggestions using AI and general horticultural knowledge. You understand and agree that:

• Information provided is for educational and informational purposes only
• We do not guarantee plant survival or health outcomes
• You are responsible for how you apply the information

4. User Content

You may upload content such as:

• Plant photos
• Notes and descriptions
• Help requests

You retain ownership of your content, but you grant us a non-exclusive, worldwide license to use, store, and process it for:

• App functionality
• AI processing
• Improvement of services

You agree not to upload:

• Illegal content
• Harmful or offensive material
• Content that violates third-party rights

5. Community & Expert Features

VERDANT may allow interaction between users and plant helpers or experts. You agree:

• To communicate respectfully
• Not to misuse help requests or spam
• That we are not responsible for advice provided by other users or third-party experts

6. Prohibited Use

You must not:

• Reverse engineer or modify the App
• Attempt to disrupt or damage the service
• Use the App for fraudulent or illegal activities
• Exploit AI or system features in unintended ways

7. Intellectual Property

All content, branding, design, and software in VERDANT is owned by Gesla LLC or its licensors. You may not copy, distribute, or reuse any part of the App without permission.

8. Subscriptions & Payments

Some features may require payment or a subscription.

• Payments are handled through the Apple App Store
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription at any time in your Apple ID account settings
• Fees are non-refundable unless required by law or platform policy
• We may change pricing with notice

9. Termination

We may suspend or terminate your access if:

• You violate these Terms
• We detect misuse or harmful behavior
• We are required by law

You may stop using the App at any time.

10. Limitation of Liability

To the maximum extent permitted by law:

• VERDANT is provided “as is” without warranties
• We are not liable for plant damage, loss, or outcomes resulting from app usage
• We are not responsible for third-party actions or advice

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after updates means you accept the revised Terms. Please check regularly at appverdant.com.

12. Governing Law

These Terms are governed by the laws of Georgia. Any disputes shall be resolved in the courts of Tbilisi, Georgia.
